A Disability Doesn't Excuse an Employee's Misconduct

The Americans with Disability Act (ADA) requires employers to make reasonable accommodations for an employee who has a disability. A recent federal appellate court decision made it clear that an employee has an affirmative duty to request accommodation that this law does not protect an employee's misconduct related to or caused by a disability.
