Wills and trusts are only two components of a good plan. Health care proxies, living wills, powers of attorney and special needs trusts are some of the other documents that may need to be considered as determined by your particular circumstances.
Speaking to an attorney as soon as possible to prepare these documents can mean avoiding substantial consequences. For example, trusts are often used for tax planning, to shelter assets and protect them from creditors, to avoid probate, to appoint someone with expertise to manage assets, and/or for long-term care and to protect those with special needs.
McKernan Law can also probate any will in New York and in New Jersey.
If someone dies without a will, an administration proceeding may be necessary. McKernan Law is experienced in these situations.
