January 1, 2025, Due Date: New York Employers Should Prepare Now for the New Paid Prenatal Leave Law
New York's amendment to the New York Labor Law Section 196-b, which provides employees with another opportunity for paid leave, will go into effect soon. Starting on January 1, 2025, New York employers must provide up to 20 hours of paid prenatal leave to eligible employees during any 52-week period.
Prenatal leave may be taken for "health care services received by an employee during their pregnancy or related to such pregnancy, including physical examinations, medical procedures, monitoring and testing, and discussions with a health care provider related to the medical care." The amendment also notes that employees may take prenatal leave in hourly increments, which are to be paid in hourly installments.
