New York State Budget Includes Enhanced Employer Obligations

The New York State enacted budget for the fiscal year 2024 changes employers' obligations by adding paid leave for prenatal care, converting unpaid break time for purposes of expressing breast milk into paid time and incorporating a sunset date into the existing COVID-19 Paid Sick Leave Law. 

Paid Prenatal Leave:
Employers are required to provide 20 hours of paid prenatal personal leave (in a 52-week calendar period) to employees during their pregnancy for the purposes of healthcare services received related to such pregnancy. 

Paid prenatal leave may be taken in hourly increments and will be paid at the employee's regular rate of pay or the applicable minimum wage rate, whichever is greater. 

Paid Lactation Breaks:
Provides 30 minutes of PAID break time for this use in addition to any other paid break or paid mealtime. 

Sunset of COVID-19 Paid Sick Leave:
July 31, 2025, is the sunset date.
