New York Clarifies Rules Regarding Sick Leave
On 12/22/21, the New York Department of Labor issued rules clarifying the Sick Leave Law.
The rules address three topics:
1) Documentation employers may require to verify use of sick leave.
2) How to count the number of employees an employer has for determining eligibility.
3) How to calculate an employee's accrual of Sick Leave.
These rules alter many previously held assumptions about Sick Leave.
Employers should review their policies to ensure that they comply with the New Rules, limit documentation requests, and review how they calculate Sick Leave.
